TERMS & CONDITIONS

1. Detailed description of goods and/or services

  • LOTUSON INTERNATIONAL TRADING cc. is a business in the Consumer Electronics and Renewable Energy consumer goods industry that sells blank media, media boxes, solar-based consumer goods, and also provides repair services for its own goods.

 

2. Delivery policy

  • Subject to availability and receipt of payment, requests will be processed within 1 business day from receipt of payment, and delivery confirmed by way of courier services or postal services - the costs of which will be paid by the customer, unless otherwise stated as per specific requirements stated by the website www.lotuson.co.za during the buying process - with the tracking/waybill number communicated to the customer as soon as bookings have been made (bookings will be made on behalf of the customer as soon as payment is received).
     

  • The risk of damage to or destruction of goods is passed to the Customer on signature of the delivery receipt upon delivery to the Customer or the Customer’s nominated representative and the Customer undertakes to insure the goods fully, until paid for.
     

  • Delivery times given are merely estimates and are not binding on the Company. The Company warrants that it will use its best endeavors to meet such delivery times, as well as liaise with courier/delivery services (including SA Post Office) to ensure goods arrive in a reasonable timeframe.

3. Return and Refunds policy

  • The provision of goods and services by LOTUSON INTERNATIONAL TRADING cc. is subject to availability. In cases of unavailability, LOTUSON INTERNATIONAL TRADING cc. will refund the client in full within 30 days, provided payment to the company has been made without delivery of goods and/or services
     

  • It is the duty of the Customer to return any defective goods to the premises of the Company’s nominee at the Customer’s own cost. Transportation arrangements must be discussed with the Company prior to the sending of the goods.
     

  • Warranty items must be carried in accompanied by its invoice and fault report to LOTUSON INTERNATIONAL TRADING CC for assessment and consultation.
     

  • No warranty on speaker unit, LED light of speaker product, or any physical damage.
     

  • Please choose your product carefully, as we do not normally give refunds if you simply change your mind or make the wrong decision. You can choose between a refund, exchange or repair, where goods are defective within the warranty period or within 48 hours if the products are wrongly described, or different from the sample shown to you. If the product(s) is/are installed, affixed or amended we will not accept a return of the product. We may charge a 20% handling fee if the return of an installed/affixed/amended product is accepted by management. Goods may not be sent back without authorization.
     

  • All warranties are immediately null and void, should any equipment be tampered with, or should the seals on equipment be broken by anyone other than the Company or its nominee, or should the goods be operated outside the manufacturer’s specifications.
     

  • Under no circumstances will the Company be liable for any damage arising from any misuse or abuse of the goods.
     

  • Under no circumstances will the company accept any correctly supplied goods and non defective goods whatsoever unless the prior written approval of management is first obtained within 48 hours of the date goods were received if using the transportation services of couriers or South African Post Office. In the event that approval for return of goods is obtained from Management more than 48 hours after receipt of goods, the Customer must pay a minimum 10% handling fee (10% of the product price as agreed upon when making payment, and excludes the courier/transportation fee).

 

4. Customer Privacy policy

  • LOTUSON TRADING INTERNATIONAL cc. shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). 5. Payment options accepted

  • Payment may be made via Visa and MasterCard.

 

6. Card acquiring and security

  • Card transactions will be acquired for LOTUSON TRADING INTERNATIONAL cc. via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

 

7. Customer details separate from card details

  • Customer details will be stored by LOTUSON TRADING INTERNATIONAL cc. separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za.

 

8. Merchant Outlet country and transaction currency

  • The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

 

9. Responsibility

  • LOTUSON TRADING INTERNATIONAL cc.) takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

10. Country of domicile

  • This website is governed by the laws of South Africa and LOTUSON INTERNATIONAL TRADING cc. chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

 

11. Variation

  • LOTUSON TRADING INTERNATIONAL cc. may, in its sole discretion, change this agreement or any part thereof at any time without notice.
